Goods are sold in their current condition at the time of sale. The absence of mention in the catalog does not imply that the lot is in perfect condition or free from restoration. The dimensions and weights of the works are given for informational purposes. An exhibition having allowed a prior examination of the pieces described in the catalog, no claim concerning their condition will be accepted once the auction has been pronounced and the object delivered. Upon request, a condition report can be provided for lots with an estimate greater than €1,000. Estimates are provided for purely indicative purposes. Mentions concerning the provenance and/or origin of the property are provided at the seller's indication and cannot engage the responsibility of Giquello SAS. The sale will be for cash in euros. Buyers will pay, in addition to the bids per lot and per tranche, the following commissions and taxes: - 25% excl. VAT from €1 to €500,000, i.e., 30% incl. VAT - 20.50% excl. VAT beyond €500,001, i.e., 24.60% incl. VAT VAT (20%) is in addition to the excl. VAT commission. PURCHASE ORDERS Any bidder wishing to make a purchase offer or bid by telephone can send their request by mail, email, or fax to Giquello SAS, accompanied by their bank and postal details. Telephone bids are a free service provided to clients who cannot travel. Giquello SAS and its employees cannot be held responsible in case of any error or telephone connection problem. When two purchase orders are identical, priority goes to the first order received. In case of adjudication, the price to pay will be the hammer price as well as the fees, under the conditions in force at the time of sale. ONLINE AUCTIONS An online bidding option is offered. These are carried out on the website https://drouot.com, which is a technical platform allowing remote electronic participation in public auctions taking place in sales rooms. The contractual partner of Drouot Live service users is the company Auctionspress. The user wishing to participate in an online auction via the Drouot Live platform must read and accept, without reservation, the terms of use of this platform (available on https://drouot.com), which are independent and in addition to these general terms and conditions of sale. BIDDER I/The successful bidder will be the highest bidder and last bidder provided that the bid is equal to or greater than any reserve price. In the event that a reserve price has been stipulated by the seller, Giquello SAS reserves the right to place bids on behalf of the seller up to the last bidding level before it, either by placing successive bids or by placing bids in response to other bidders. However, the seller will not be allowed to place bids themselves directly or through an agent. The hammer blow will materialize the end of bidding and the pronouncement of the word "adjudged" or any other equivalent will result in the formation of the sales contract between the seller and the last successful bidder. In case of a double bid recognized as effective by the auctioneer, the lot will be immediately put back on sale, any interested person being able to compete in the second adjudication. As soon as the adjudication, the objects are placed under the sole responsibility of the buyer. It will be up to the successful bidder to insure the lot as soon as the adjudication. Giquello SAS cannot be held responsible in case of loss, theft or damage to its II/VAT - Margin scheme - goods not marked with a symbol: A/All unmarked goods will be sold under the margin scheme and the hammer price will not be increased by VAT. The purchase commission will be increased by an amount representing VAT (20% except for books 5.5%) included in the margin. This VAT is part of the purchase commission and will not be mentioned separately on our documents. III/Lots from outside the EU under the temporary admission scheme: (indicated by an * in the catalog and/or announced at the beginning of the sale). To the commissions and taxes indicated above at the beginning of the terms of sale, additional fees of 5.5% excl. VAT of the hammer price or 20% excl. VAT for jewelry and watches, wines and spirits, multiples and automobiles, additional fees increased by VAT currently 20% (5.5% for books) must be added. IV /Conditions for reimbursement of additional fees and VAT (cf: 7th VAT Directive applicable from 01.01.1995) A/ If the lot is exported to a third country outside the European Union Additional fees as well as VAT on commissions and additional fees can be reimbursed to the successful bidder not resident in the European Union upon presentation of export justifications outside the EU provided that they have sent to Giquello sas copy n°3 of the customs export document and that this export occurred within two months from the date of the auction (after this period, no reimbursement will be possible). Giquello sas must appear as the sender of said customs document. B/ If the lot is delivered in an EU Member State VAT on commissions and additional fees can be reimbursed to the successful bidder from the European Union justifying an Intra-Community VAT number and a document proving delivery in their member state subject to the provision of justifications for transport from France to another member state, within one month from the date of sale (after this period, no reimbursement will be possible). PAYMENT The successful bidder is obliged to pay cash and provide their name and address. The payment of the lot will be in cash, for the full price, fees and taxes, even if an export license is required. In application of TRACFIN rules, payment cannot come from a third party. In case of payment by uncertified check, the delivery of the objects may be deferred until the check is guaranteed to be cashed. A period of several weeks may be necessary. Buyers can only take delivery of their purchases after a bank payment. Checks drawn on a foreign bank will only be authorized after prior agreement from the Sales Company. For this, buyers are advised to obtain, before the sale, a credit letter from their bank for a value approximating their purchase intention, which they will transmit to the Sales Company. Cash payment in accordance with decree n°2010-662 of June 16, 2010, taken for the application of article L.112-6 of the monetary and financial code, relating to the prohibition of cash payment of certain debts. Buyer slips are payable upon receipt. In default of payment within 30 days, Giquello SAS may automatically and without prior reminder, demand payment of an indemnity of 40 euros for recovery costs (Art L 441-3 and Art L 441-6 of the Commercial Code). IN DEFAULT OF PAYMENT In accordance with the provisions of article L. 321-14 of the Commercial Code, in default of payment by the successful bidder, after an unsuccessful formal notice, the property will be put back on sale at the request of the seller on the defaulting bidder's account; if the seller does not make their request within one month from the adjudication, they give us full mandate to act in their name and on their behalf, at our choice, either to sue the buyer for annulment of the sale three months after the sale, or to sue them for execution and payment of said sale, asking them in addition and in both cases for all damages, costs and other sums that we deem desirable. The voluntary sales operator is a member of the Central Register for the Prevention of Unpaid Debts of Auctioneers, where payment incidents may be registered. Rights of access, rectification and opposition for legitimate reasons are to be exercised by the debtor concerned with Symev - 15 rue Freycinet 75016 Paris. CULTURAL PROPERTY The French State has a right of pre-emption over works of art or private documents offered for public sale. The exercise of this right occurs immediately after the hammer blow, the State representative then manifesting the latter's will to substitute for the last bidder, and having to confirm the pre-emption within 15 days. Giquello company assumes no responsibility for the conditions of pre-emption by the French State. The export of certain cultural goods is subject to obtaining a certificate of free circulation for a cultural good. The time required to obtain said certificate cannot in any case justify a deferred payment. Giquello SAS and/or the Seller cannot in any case be held responsible in case of refusal of said certificate by the authorities. *CITES Lots preceded by the symbol * are made of materials classified in Annex I of the Washington Convention and Annex A of the European Community Regulation. Given their age, these specimens are well prior to June 1, 1947. Following the decree of August 16, 2016, relating to the prohibition of trade in elephant ivory and rhinoceros horn on national territory, modified by the decree of May 4, 2017, and December 16, 2021, worked ivory objects dating from before 1947 are subject to obtaining an intra-community certificate (CIC) issued to the buyer after the sale so that the latter can circulate freely with the object within the European Union. For shipment outside the European Union, the object is subject to obtaining a CITES re-export certificate. It is up to the buyer to inquire about the customs laws and regulations that apply before bidding on any lot containing elements of protected species. In accordance with the provisions of article L321-17 of the Commercial Code, the liability action against the OVV is prescribed by 5 years from the adjudication or the appraisal.
